CCRs (Conditions, Covenants & Restrictions) At A Glance
This summary reference provides an overview of the governance elements that most owners in the LVW community find most relevant. The complete language citation is provided after each item. This document does not override the Declaration and By-Laws of this Association. We encourage everyone to read the full text. Please consult with any Board member if you have questions or need further clarification.
1. This is a pet-free community. While legitimate service and emotional support animals are welcome (with current, valid documentation), no other animals are permitted. We use Florida’s strict requirements regarding acceptable documentation. In compliance with federal ADA guidelines, a maximum of one animal per disability is permitted. 2. This is a non-smoking community. Residents and guests may NOT smoke in their condo units, on their lanais or patios, outside either doorway, in building entryways, on our sidewalks, or on any green space in the community. Smoking is only permitted in the parking lots. (2013 Amendment to Declaration, XIII, Use and Occupancy, B)
3. No one under the age of 40 may own or reside in a condominium in this Association. Anyone not listed on the approved Owner/Renter application who resides in our community more than 30 days in any calendar year must submit an application for Extended Guest Residency. Such guests must be at least 40 years old, unless the Board grants special dispensation. Also, unregistered vehicles in our parking lots for more than 30 days in any calendar year will be subject to towing at owner expense. (1994 Amendment to Declaration, XIII, Use and Occupancy, R)
4. Any guest using Association amenities must be accompanied by the unit owner. This includes use of the pool and fishing from the LVW lakefront area.
5. No trailers or RVs may be parked in Association parking lots longer than 24 hours. Additionally, no vehicle is permitted to be parked on the lawns anywhere in the community.
6. Each owner must provide proof of insurance on the contents of the condo unit. Such documentation must be submitted annually. (2019 Amendment to Declaration, XII, C)
7. Each condo unit owner is responsible for monthly HOA fees, assigned based on a chart developed at the Association’s inception. The Board determines (annually) if and how these fees need to be adjusted to address community budgetary needs. (Declaration, IV)
8. The owner’s property rights end at his/her/their front door. All spaces beyond the unit are considered Common Elements, and, as such, are controlled by the Association. If the condo unit includes an approved/deeded patio, resident use and control ends at the patio edge. Thus, all entryways, planting beds, lampposts, exterior walls, and all other spaces outside each unit are to remain uniform, undecorated, and unaltered, except by written permission of the Board. 9. The financial aspects of living in this condo community are carefully spelled out. HOA fees, special assessments, and the penalties for non-payment are clearly explained in Declaration, Section X, Assessments.
10. Units can be rented out for a minimum of 90 days to a lessee. Prior to such a rental, an application must be submitted and approved by the Board. Prior to occupancy, the Board must receive a copy of the signed lease. (Declaration, XI, D)
11. Residents and guests must demonstrate courtesy in close community living. This includes responsible service animal conduct, noise consideration, compliance with pool use regulations, and generally respectful behaviors. (Declaration, XIII, B & J)
12. No signage of any kind may be posted in any unit window or common area without written permission from the Board. (Declaration, XIII, H)
13. Each owner is responsible for the maintenance and repair of all interior structures and appliances within the unit, and the associated mechanical closet (if applicable). Additionally, owners are responsible for all costs associated with doors and windows. Exterior windows must be aesthetically consistent with the Association norm. (Declaration, XIII, L)
14. Any alteration to the exterior of any unit requires prior Board approval. (Declaration, XIII, C, 1)
15. The Board has the right to enter any unit for the purpose of “maintenance, inspection, repair” or in emergency situations. Each owner is required to provide a working key and/or entry code to allow for compliance with this statute. Board members will extend courtesy to owners in such circumstances with prior notification, if circumstances allow. (Declaration, XIV, C, 2)
16. The By-Laws of this Association specify the responsibilities of the Board of Directors and the assigned tasks for the President, Vice President, Treasurer, Secretary, and Directors-at-Large. (Articles I-III)
17. This Association holds monthly Board meetings from November through April each year. These meetings are usually held in the Community Room at 631A on the second Tuesday of each month. The Association convenes annually in March to receive reports, participate in planning, vote on actionable items, and resolve community issues as required by the governance structure. Such meetings can be conducted remotely, and have been on multiple occasions. All such gatherings are open to all residents and documented via minutes, which are also available.
18. Lakes Village West relies upon and regularly uses digital communication to engage and inform all community owners and residents. Thus, we require that each owner/resident has and uses a valid email address to receive such vital information. Those without direct access to email may utilize a family member or other trusted individual who will be responsible for communicating relevant messages.
19. Recognizing that special circumstances may arise that require exceptions to these regulations, the Board is open to individual appeals by owners and residents. In such situations, the Board is able to authorize temporary allowances with sufficient cause.
